Terms of Service

Introduction

These Terms of Service ("Terms") govern your use of the EUPickleball website and services (the "Service") operated by I.P.A. GmbH ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

User-Generated Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"), specifically information about pickleball courts and facilities. The Content you post on or through the Service is subject to the following terms:

Content Responsibility

• You are solely responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.
• You represent and warrant that you own or have the necessary rights to post the Content on our Service, and that the Content does not violate the rights of any third party (including but not limited to intellectual property rights and privacy rights).
• You must ensure that any information you provide about pickleball courts and facilities is accurate and up-to-date to the best of your knowledge.
• You acknowledge that posting location information, including addresses and contact details of facilities, is done at your own discretion and risk.

Content Restrictions

You agree not to post Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Infringes on any proprietary rights of any party
• Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware
• Is false, inaccurate, or misleading
• Is used to impersonate any person, or to misrepresent your identity or affiliation with any person or organization
• Includes personal or identifying information about another person without that person's explicit consent
• Violates the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other rights of any person

Content Moderation

We reserve the right, but not the obligation, to: (1) monitor the Service for violations of these Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Content; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Service or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Service in a manner designed to protect our rights and property and to facilitate the proper functioning of the Service.

Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of I.P.A. GmbH and its licensors. The Service is protected by copyright, trademark, and other laws of both Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of I.P.A. GmbH.

By posting Content on the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Content on and through the Service. This license ends when you delete your Content or your account.

You acknowledge that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms.

Limitation of Liability

In no event shall I.P.A. GmbH, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use or alteration of your transmissions or content

We do not warrant that:

• The information about pickleball courts and facilities provided by users is accurate, complete, or up-to-date;
• The Service will be uninterrupted, timely, secure, or error-free;
• The results that may be obtained from the use of the Service will be accurate or reliable;
• The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
